The deal
You buy balm. We ship balm. We stand behind it with a 30-day guarantee.

These terms explain what you're agreeing to. The short version. Don't be shady, don't steal our stuff, use the product as intended. If something goes wrong, we'll fix it. We reserve the right to refuse service to scammers and people who make our lives difficult.

Here's everything.

1. Who we are
Drink Styx Pty Ltd t/a NOOKS Balm operates nooksbalm.com and related domains, and sells skincare from Melbourne, Australia.

By using our site or buying from us, you agree to these Terms of Service, our Privacy Policy, our Refund Policy, and our Shipping Policy.

We can update these terms. When we do, we'll post the new version and update the date. Keep using the site after changes and that counts as accepting them. We won't email you over a fixed typo. Major updates get announced.

2. Who can shop here
Anyone. If you're under 18, you confirm you have a parent or guardian's permission to purchase. You must be legally able to enter contracts in your jurisdiction and not prohibited from receiving Australian goods.

3. Account security
If you create an account, you're responsible for keeping your password secure, for all activity under your account, and for telling us straight away if it's compromised. We're not liable for losses from unauthorised access if you didn't protect your login. And nothing along the lines of "password123." You know better.

4. What you agree not to do
By using our site, you will not:

  • Use our products for illegal purposes
  • Provide false or fraudulent information
  • Attempt to hack, disrupt, or damage our site
  • Use bots to scrape our content
  • Impersonate NOOKS or claim affiliation without permission
  • Harass our staff or other customers
  • Abuse our refund policy through serial refunding or fraud
  • Resell commercially without authorisation
  • Post fake reviews or manipulate ratings

We reserve the right to refuse service, cancel orders, or terminate accounts if you violate these terms. No warning required.

5. Product information and accuracy
We aim to be accurate with descriptions, ingredients, pricing, images, and stock. Screen colours vary, natural ingredients have natural variation, and humans make mistakes. We reserve the right to correct errors, update information, discontinue products, and limit quantities. If we badly bungle a price, like a tin listed at $0.01, we'll contact you before charging and give you the option to cancel.

6. Orders, payment and pricing
When you order, you're making an offer to buy. We can accept or reject it. We reserve the right to refuse or cancel fraudulent orders, limit quantities per customer, refuse orders from resellers or bulk buyers, and cancel orders if a product becomes unavailable.

All prices are in AUD, GST included. Payment is processed immediately via Shopify's secure system, and we don't store your full card details.

Pricing errors. If we find one after you've ordered, we'll let you know. You can pay the correct price or cancel. No reply within 48 hours means the order is cancelled and refunded.

Discount codes. One per order, can't be combined, can't be applied after ordering, no cash value. Abused codes get revoked.

7. Shipping and delivery
What we're responsible for: packing your order properly, handing it to the carrier on time, and providing tracking.

What we're not responsible for: carrier delays from strikes, weather, or holidays, incorrect addresses you provided, packages marked "delivered" that you can't find, customs delays or fees on international orders, and your neighbour's dog eating your package.

Once tracking shows "delivered," the product is legally yours. If it's lost or stolen, see our Shipping Policy. We'll investigate, though we can't guarantee a replacement. Shipping times are estimates, never guarantees.

8. Refunds and our 30-day guarantee
See our full Refund Policy for details. The quick version:

  • If NOOKS isn't working for you, you have 30 days from delivery for a refund of the product price. Original shipping isn't refunded.
  • Full refund, no deductions, for adverse reactions, damaged, defective, or wrong items.
  • Nothing to post back. You keep the tin.

We reserve the right to refuse refunds where you're clearly abusing the policy or providing fraudulent information.

9. Product use and disclaimers
NOOKS is a cosmetic product, not medicine.

Intended for:

  • External topical use only
  • Dry, tight, flaky, chapped, or easily irritated skin
  • Everyday barrier support and comfort

Not intended for:

  • Internal use, so don't eat it as a meal
  • Open wounds requiring medical attention
  • Serious infections
  • Diagnosed conditions requiring prescription treatment

Please also:

  • Patch test first if you have sensitive skin or allergies
  • Discontinue if irritation occurs
  • Treat it as comfort and barrier care, not a replacement for medical treatment. See a doctor for anything serious
  • Note it hasn't been evaluated by the TGA for treating, curing, or preventing any disease
  • Remember individual results vary

For a severe reaction, meaning difficulty breathing, severe swelling, or anaphylaxis, stop use immediately and seek emergency medical attention. That one's a hospital, not us.

Allergens. Contains shea butter, botanical oils, and natural waxes. Check the full ingredient list if you have known allergies. We're not liable for reactions to ingredients you already knew you react to.

10. Intellectual property
Everything on this site is owned by Drink Styx Pty Ltd t/a NOOKS Balm or licensed to us: brand name, logo, formulations, website content, photography, packaging, and marketing materials.

You may not copy our formulation, use our brand name or logo without written permission, reproduce our website content, scrape our product descriptions, or use our images commercially.

You may share our product photos on social media with credit, write honest reviews using product images, and link to our website.

Violate our IP and we'll ask you to stop. Ignore that and lawyers get involved.

11. User-generated content
If you post a review, photo, or other content, you grant us a non-exclusive licence to use it for marketing, you confirm you own it or have permission to share it, and you agree it doesn't violate anyone else's rights. We can use it on our site, our social, and our ads, and we can remove content that's false, abusive, illegal, or clearly fake. You keep ownership. You're just giving us permission to use it.

12. Third-party links
Our site links to social media, payment processors, carriers, and other websites. We're not responsible for their content, privacy practices, or terms. Click those links and you're subject to their rules, not ours.

13. Limitation of liability
What we're liable for: sending you the product you ordered, honouring our 30-day guarantee, and complying with Australian Consumer Law.

What we're not liable for, to the fullest extent permitted by law: indirect or consequential damages, loss of profits, data, or business opportunities, reactions to allergens you already knew about, misuse of the product, third-party actions like carrier disasters or Shopify outages, and unrealistic expectations, since we're a balm, not a miracle.

Maximum liability is the amount you paid for the product.

Australian Consumer Law. Nothing here limits your rights under the ACL. If our product is faulty, unsafe, or significantly different from its description, you're entitled to a remedy regardless of what we say here. Our 30-day guarantee sits on top of those minimum legal requirements.

14. Indemnification
You agree to cover our reasonable legal costs if you violate these terms and it causes us legal trouble, misuse the product and blame us, post provably false defamatory content about us, or your actions result in legal claims against us. In plain terms, if you do something you shouldn't and we get dragged into it, you're covering the costs.

15. Termination
We can terminate or suspend your access if you violate these terms, abuse our refund policy, engage in fraud, harass our staff, or do anything that makes us not want to do business with you. No refund where termination is due to your violation. You can end things anytime by closing your account or simply not using the site.

16. Governing law and disputes
These terms are governed by the laws of Victoria, Australia.

If we have a dispute, email hi@nooksbalm.com and let's sort it out like adults. If that fails, mediation before litigation. If mediation fails, legal action in Victorian courts. You agree to Victorian jurisdiction and to bringing individual claims only, except where the law allows otherwise.

17. Severability
If one part of these terms is found illegal or unenforceable, the rest still applies, and we'll replace the invalid part with something lawful that achieves the same intent. One bad clause doesn't kill the whole agreement.

18. Entire agreement
These Terms, plus our Privacy Policy, Refund Policy, and Shipping Policy, are the complete agreement. Prior conversations or emails don't override what's written here. If we make an exception for you, that doesn't waive our right to enforce these terms later.

19. Force majeure
We're not liable for delays or failures caused by events beyond our reasonable control: natural disasters, pandemics, war, terrorism, civil unrest, government actions, supplier failures, or carrier strikes. If this happens, we'll communicate, try to fulfil your order as soon as we can, or offer a refund if we can't deliver within a reasonable time.

20. Prohibited use
Commercial resale. Don't buy in bulk to resell on Amazon, eBay, or anywhere else without authorisation, don't represent yourself as an authorised NOOKS retailer, and don't remove or alter our packaging for resale. If wholesale interests you, email us. We might work with you.

Fraud. Stolen cards, fake accounts for multiple discounts, manipulating referral or review systems, chargeback fraud. We track this, we'll ban you, and we'll report or pursue it where appropriate.

22. Acknowledgment
By using our site or purchasing from NOOKS, you acknowledge that you've read and understood these Terms, agree to be bound by them, are legally able to enter this agreement, and that the information you provide is accurate.

The bottom line
Small Australian business. Skincare that works. A 30-day guarantee.

These terms protect both of us. You get consumer protections and clear policies. We get protection from fraud and abuse. Use the product as intended, don't be shady, and if something goes wrong, talk to us.
